Amendment 98 Section 2 (the register's first-listed source) is published as a scanned image with no text layer, so this value instead rests on the Department of Health's implementing rules, which describe only a medical marijuana program with no adult-use channel.

The registry is the whole of the cannabis market here, and a card is what gets a person through a dispensary door. Arkansas licenses no recreational store or delivery service to sit beside it.

Medical status

Your paperwork goes to the Department of Health, which registers you and issues the card. The rules the counter itself works to are written separately from the ones you meet, so the card in your hand is only the first half of the arrangement.

Hemp-derived products

Sale requires a permit from Arkansas Tobacco Control. A hemp-derived product may not be combined with nicotine, tobacco, or other non-hemp additives, or contain enough tetrahydrocannabinol to create a danger of misuse, overdose, or inaccurate dosage, under Ark. Code 20-56-403(d).

Arkansas put this counter under Tobacco Control, the same body that permits cigarette and vape sellers, so the permit a shop holds comes from that side of the state. The strength test is written as a judgment about misuse and dosing rather than as one percentage, so a product's standing depends on how the state reads it.

On buying, Arkansas states: No more than two and one-half ounces (2 1/2 oz.) of usable medical marijuana during any fourteen-day period. (20 CAR § 810-1501 Dispensing medical marijuana)

The meter runs as a rolling 14-day window, so a purchase made last Friday still counts against today's total. The same dispensing rule that sets the figure also covers an order brought to your door, so a delivery is counted no differently.

Minimum age

The Department does not issue a registry identification card to a qualifying patient under eighteen unless the physician has documented the risks and benefits to the patient and a parent, guardian or legal custodian, that person consents in writing and controls acquisition, dosage and frequency, and registers as the patient's designated caregiver.

At 18 the card becomes a patient's own to use. A younger patient does not stand at the counter at all, because the registered parent or guardian holds the buying side and decides the dosage and how often.

Where you can buy

You can buy lawfully from a licensed medical dispensary and a licensed delivery service. (20 CAR § 810-1501 Dispensing medical marijuana)

CAR 810-1501 provides for orders placed for delivery, recording the registry identification numbers of the agents assigned to deliver, the delivery address and the estimated time of delivery.

Delivery in Arkansas comes from the dispensary itself, through agents the state has given registry numbers, so no outside courier is part of the chain. Hemp shops permitted by Tobacco Control are a different counter with a different permit, and nothing they sell comes from the medical program.
