Is weed legal in Delaware?

Recreational status

Recreational cannabis is legal in Delaware. (4 Del. C. § 1309: Lawful operation of marijuana-related establishments)

A successor version of this section, adding infused beverages to the licensed retail scheme, takes effect October 21, 2026; the licensing structure recorded here is unchanged between the two versions.

An adult of 21 buys here without registering for anything first. The amendment due in October adds a product type to what a licensed shop may sell, and the licensing scheme behind those shops stays as it is.

Medical status

A full medical cannabis program runs in Delaware, serving patients the program registers. (16 Del. C. § 4902A: Definitions (Delaware Medical Marijuana Act))

Compassion center is what Delaware calls a medical outlet, and a registered one is the only place a patient's supply is grown. With recreational shops open at 21, the register now matters most to patients too young for that door.

Hemp-derived products

Delaware has changed what hemp-derived products may be sold, and the change has not taken effect. (4 Del. C. § 1313A: Hemp products not affected)

This section is only effective October 21, 2026. Once effective, it protects the manufacture, distribution, and sale of hemp products or cannabinoid products that are not infused beverages, provided they comply with applicable hemp laws; it exempts a hemp retail store that sells no marijuana, marijuana products, or infused beverages from needing a license under this chapter; and it provides that a product is not treated as marijuana solely because it contains cannabinoids, including up to 0.3% delta-9 THC by dry weight.

A dated section is not a rule you can rely on today, and this one lands in October. From then a shop that sells hemp and no marijuana sits outside the marijuana license scheme instead of inside it.

Home cultivation

Delaware allows nobody to grow cannabis at home. (16 Del. C. § 4764A: Legal marijuana-related activity)

Delaware's medical marijuana act does not provide for patient or caregiver home cultivation either: a registered compassion center is the only entity described as cultivating marijuana for a qualifying patient's medical use.

Zero is the count for a patient too, so no card opens a door that is shut to everyone else. Every lawful gram in Delaware therefore starts at a licensed business and not in someone's spare room.

Possession and purchase limits

The possession limit, as Delaware states it: 1 ounce or less of marijuana in the form of leaf marijuana, 12 grams or less of concentrated cannabis, or cannabis products containing 750 milligrams or less of delta-9-tetrahydrocannabinol. On buying, Delaware states: 1 ounce or less of marijuana in the form of leaf marijuana, 12 grams or less of concentrated cannabis, or cannabis products containing 750 milligrams or less of delta-9-tetrahydrocannabinol. One set of figures does both jobs here, so the most you may buy is also the most you may hold, and a second trip does not raise it. Each form is counted its own way: leaf by weight, concentrate by weight, everything else by milligrams of THC.

Minimum age

You must be 21 or over to buy without a medical card. (4 Del. C. § 1306: Individuals under age 21; prohibitions)

Delaware sets no minimum age for a patient. (16 Del. C. § 4902A: Definitions (Delaware Medical Marijuana Act))

A patient younger than eighteen may hold a registry identification card, limited to marijuana oil and certified by a physician in a named pediatric specialty, so the chapter sets no floor.

A physician in a named pediatric specialty is what stands in for an age at the youngest end of this program. The card such a patient holds reaches marijuana oil and nothing else.

Where you can buy

You can buy lawfully from a licensed recreational dispensary and a licensed delivery service. (4 Del. C. § 1309: Lawful operation of marijuana-related establishments)

Two routes are licensed here, a counter you walk up to and a delivery that comes to you. With no plant lawful at home, one of the two is where every gram you hold in Delaware begins.
