Is weed legal in Wyoming?

Recreational status

Recreational cannabis is not legal in Wyoming. (W.S. 35-7-1031. Unlawful manufacture or delivery; counterfeit substance; unlawful possession)

W.S. 35-7-1014 classifies marihuana and tetrahydrocannabinols as Schedule I, but a schedule listing alone states no penalty; 35-7-1031 is the operative prohibition making manufacture, delivery, or possession of a controlled substance without authorization a crime. A separate, unlicensed allowance exists for hemp and hemp products at or below 0.3 percent THC; see hemp_product_status and purchase_channels. That is a distinct product category from marijuana and does not change this value.

Wyoming exempts hemp from its controlled substances chapter and leaves marijuana inside it, which is why one can sit on a shop shelf and the other cannot. The prohibition reaches manufacture, delivery and possession alike, and no age or purpose lifts it.

Medical status

No medical cannabis program runs in Wyoming. (W.S. 35-7-1031. Unlawful manufacture or delivery; counterfeit substance; unlawful possession)

No prescription or practitioner's order for marihuana, tetrahydrocannabinol, or a synthetic equivalent is valid in Wyoming, with one narrow exception: a drug that has received final approval from the United States Food and Drug Administration, including dronabinol. That FDA-approved synthetic THC drug is available nationwide by ordinary prescription under federal law; it is not a Wyoming medical cannabis program, and no registered source establishes one.

Wyoming makes no practitioner's order for marijuana or THC valid, so no certification exists here to apply for and no card to carry. The state's one exception is a drug with final federal approval, dispensed on an ordinary prescription, which is not a cannabis program.

Hemp-derived products

Wyoming permits the sale of hemp-derived products and limits which ones. (W.S. 35-7-1063. Exceptions to provisions)

W.S. 35-7-1063 defines hemp as the plant or a product made from it "with no synthetic substances and with a THC concentration of not more than three-tenths of one percent (0.3%) on a dry weight basis". The no-synthetic-substances condition is narrower than the federal definition and excludes cannabinoids produced by conversion rather than grown. Federal law also applies; see the federal record. The possession or use of hemp or hemp products for any purpose or application, and hemp production, processing, or testing under W.S. 11-51-101 through 11-51-107, are exempted from the controlled substances chapter's provisions and penalties. W.S. 11-51-102(b) states directly that 'the possession, purchase, sale, transportation and use of hemp and hemp products by any person is allowable,' subject only to the production/processing license in 11-51-103(a) and the 0.3 percent THC, no-synthetic-substance definition itself; neither registered source adds a further sale-specific restriction -- no additional potency cap, age gate, or retailer licensing -- on hemp products themselves.

Wyoming's definition carries a condition the federal one does not, because the plant or product must contain no synthetic substances, which leaves out cannabinoids made by converting one into another rather than growing them. A product can therefore sit at or below the THC figure and still fall outside what this state calls hemp.

Home cultivation

Wyoming allows nobody to grow cannabis at home. (W.S. 35-7-1031. Unlawful manufacture or delivery; counterfeit substance; unlawful possession)

Cultivating marijuana is manufacturing a Schedule I controlled substance: 'Any other controlled substance classified in Schedule I, II or III, is guilty of a crime and upon conviction may be imprisoned for not more than ten (10) years, fined not more than ten thousand dollars ($10,000.00), or both.' No registered source states a plant count or any quantity below which cultivation is lawful, for a medical purpose or otherwise, because there is no medical or adult-use program to authorize it.

Growing a plant is manufacturing a Schedule I substance here, which is why no plant count appears in the statute at all. Wyoming has neither a medical program to authorize an exception nor a recreational law to write one.

Possession and purchase limits

The possession limit, as Wyoming states it: No amount may lawfully be possessed. Possessing marijuana (a controlled substance in plant form), in any amount, is a crime. (W.S. 35-7-1031. Unlawful manufacture or delivery; counterfeit substance; unlawful possession)

Possessing three ounces or less of a controlled substance in plant form is a misdemeanor, punishable by up to twelve months' imprisonment, a fine of not more than $1,000, or both (five years and $5,000 for a third or subsequent offense); possessing more than three ounces is a felony punishable by up to five years' imprisonment, a fine of not more than $10,000, or both. Other forms carry much lower thresholds for the same misdemeanor/felony line: three-tenths of a gram in liquid form, or three grams in powder, crystalline, pill, or capsule form.

On buying, Wyoming states: No amount may lawfully be purchased. Wyoming licenses no retailer to sell marijuana or THC products in any amount. (W.S. 35-7-1031. Unlawful manufacture or delivery; counterfeit substance; unlawful possession)

There is no separate purchase-limit statute; a purchased amount is possessed, and any possession of marijuana or tetrahydrocannabinols is a crime under this same section (see possession_limit). Hemp meeting the 0.3 percent THC definition in W.S. 11-51-101(a)(iii) is not a controlled substance for this purpose and is not subject to this limit.

Wyoming's line between a misdemeanor and a felony moves with the product's form, so a liquid and a plant are measured on very different scales. Hemp inside Wyoming's definition is not counted against either figure, because the exemption puts it outside the offense.

Minimum age

There is no recreational channel in Wyoming, so no recreational age applies. (W.S. 35-7-1031. Unlawful manufacture or delivery; counterfeit substance; unlawful possession)

There is no adult-use channel: manufacture, delivery, or possession of marijuana is a crime for a person of any age under this section, so no purchase age applies.

Null, not no_minimum, because there is no medical cannabis program of any kind here: no practitioner may validly prescribe or dispense marihuana or tetrahydrocannabinol for any patient of any age, the sole exception being an FDA-approved synthetic drug (dronabinol) available nationwide by ordinary prescription, not a state medical cannabis program.

Both blanks have the same cause. Wyoming runs no cannabis counter and registers no patients, so no transaction exists for an age to govern, and the hemp sections the state does have add no age of their own.

Where you can buy

You can buy lawfully from a retailer of hemp-derived or CBD products. (W.S. 11-51-102. Hemp as agricultural crop; use of hemp)

W.S. 11-51-102(b) states that 'the possession, purchase, sale, transportation and use of hemp and hemp products by any person is allowable.' There is no licensed adult-use or medical dispensary channel: W.S. 35-7-1031 makes manufacturing, delivering, or possessing marijuana or tetrahydrocannabinols in any amount a crime, and no registered source describes a delivery service.

Wyoming licenses the growing and processing of hemp and leaves the selling of it unlicensed, so the shelf you buy from sits in an ordinary store rather than a licensed one. No dispensary of either kind operates here, and no delivery channel appears in the statutes.
